This is not living up to the basic standard of care for which doctors are required to live up to, and this failure to treat could result in the doctor being sued.

A surgery could go wrong in many ways, but just because a surgery is not successful doesn’t mean the doctor was negligent. Some errors during surgery that could result in a lawsuit include using instruments that are not sterile, performing the wrong procedure, administering the wrong amount of anesthesia, and other similar situations.
