On January 28, 2019, the New York State legislature passed the Child Victims Act (S.2440) that reforms New York State’s outdated statute of limitations for child sexual abuse.
These much needed reforms include raising the criminal statute of limitations by five years or until victims are 28 years old for felonies and 25 years old for misdemeanors; and raising the civil statute of limitations for those seeking redress for physical, psychological or other injury caused by child sexual abuse, up until the age of 55. This legislation also includes a one-year window, starting six months from the effective date of the bill (August of 2019) during which victims of any age or time limit can come forward to prosecute their abusers.
